Know the elements of a semi truck accident case

Being struck by a semi truck is something that can change the course of your life. The effects of these accidents can mean that you aren't able to work any longer and that you are facing a lifetime of medical care. If you opt to file a lawsuit for the accident, you will have to determine several things. One of the first things you need to determine is who to hold accountable for the accident. You might think that the obvious choice here is the trucker, but that might not be the only option that you have.

The circumstances of the big rig crash might lead you to other defendants. The logistics company might be a defendant if the policies governing the truckers played a part in the accident. The insurance company that covered the trucker might also be a defendant in the accident. Even manufacturers of components of the truck or the manufacturer of the truck might be liable for the accident.

Next, you will likely need to show that negligence caused the accident. You would have to show that the trucker owed you a duty of care and failed to meet that duty. You would then have to show that the failed duty led to the accident that caused your injuries.

Other elements might be necessary in your case. You should evaluate the conditions of the accident to determine what you need to include. From there, you can shore up your claim for compensation.
